Chapter 6 - DAMIAN ROTH

Damian Roth’s trial on the old Hastings charges began almost a year after the penthouse.
By then, the current financial cases had expanded.
The Newark warehouse fire produced separate federal charges against subcontractors and Roth executives.
Damian’s false-imprisonment case involving Clara proceeded too.
Nothing combined neatly.
Courts dislike cinematic structure.
Different jurisdictions.
different evidence.
different victims.
Dante attended only where required.
That surprised everyone.
Old Dante would have sat in the first row every day.
New Dante did not want the trial to become eye contact between two powerful men while everyone else disappeared.
Samuel and Elise Reed were dead.
Clara was a victim in another case.
Warehouse workers had their own story.
Then Damian testified in the Hastings case.
Against counsel’s advice, according to media.
He admitted:
he helped Malcolm obtain access information.
he knew records would be destroyed.
he believed family was out.
he panicked after deaths.
he helped cover the payment trail.
Then:
“I did not order the fire.”
Prosecutor:
“Did you stop it?”
“No.”
“Did you verify the Reeds were gone?”
“No.”
“Did you know a six-year-old lived there?”
“Yes.”
“Did you proceed anyway?”
Damian looked at jury.
“Yes.”
There.
No grand justification.
Then defense emphasized:
Damian was twenty-six under domineering father.
Malcolm controlled money and employees.
Damian feared him.
True.
Then prosecutor:
“Were you free to call police?”
Damian:
“Yes.”
“Did you?”
“No.”
Understanding coercive family culture did not erase agency.
Then Helen Ward.
Defense argued Damian requested meeting because he wanted to cooperate.
True.
That fact supported remorse after fire.
It did not erase participation before.
Then Clara’s mother’s death.
No evidence Damian ordered pursuit.
Malcolm did.
Damian knew after.
He helped insurer settle.
Again:
cover-up after.
Then verdict.
Damian convicted on some old arson-conspiracy-related counts and acquitted on one count requiring proof of a particular intent prosecutors could not establish.
No sweeping “murderer” verdict.
Sentencing accounted for deaths.
Dante listened from another room.
He felt nothing.
Then anger at feeling nothing.
Therapist later said:
“You expected a verdict to give you a childhood emotion?”
He hated therapists.
“Yes.”
“It can’t.”
Then current financial case.
Damian also pled guilty to fraud involving port contracts and obstruction.
Newark fire:
prosecutors proved he authorized sabotage but disputed whether he intended fire while workers present.
He pled to serious reckless/endangerment-related and conspiracy counts under agreement rather than attempted murder.
Specific.
Then Clara’s false imprisonment.
Damian pled.
He apologized in court.
Clara did not accept or reject.
No reply.
Then sentencing total significant.
Not lifetime.
Dante expected to feel cheated.
Instead, he felt tired.
Then Marco.
He watched verdict from home.
Called Dante.
No answer.
Dante returned call next day.
Marco said:
“He should have told you.”
Dante laughed bitterly.
“So should everyone.”
Marco accepted.
Then Dante asked:
“Why did you never tell me Helen left a tape?”
“I didn’t know.”
That answer surprised.
Some secrets were not his.
Good.
Then Dante’s own legal exposure.
Independent review and federal port investigation produced charges.
Unlawful lending conspiracy.
bribery.
racketeering-related financial conduct.
coercive collection.
No murder.
No Roth fire.
His lawyers negotiated.
Dante had choices.
He could litigate everything.
Some evidence contestable.
He chose to plead to specific offenses supported by records.
Why?
Not because Clara told him to.
She explicitly said:
“Do not make me the reason you become accountable.”
Good.
He accepted.
Then sentencing was months away.
He had time.
Too much.
He began restructuring Costa Holdings.
Legitimate operations separated under independent management.
Illegal lending shut.
certain businesses sold.
compliance monitor appointed under agreements.
Employees asked whether the empire was ending.
Dante said:
“Parts that should end are ending.”
No hero language.
Then one employee, Maria Torres, asked:
“Will our pensions survive?”
Important.
Yes.
Independent administrators protected.
Reform that sacrifices ordinary workers for symbolic cleansing is not clean.
Then Dante met Clara for coffee.
First non-case meeting.
Public place.
No bodyguards inside.
Kieran nearby outside.
Clara said:
“You’re going to prison.”
“Probably.”
“That’s a bad first date.”
He looked.
“Is this a date?”
“No.”
“Then why say first?”
She smiled.
Caught.
Then serious:
“I don’t know what I want with you.”
“Good.”
“Why good?”
“Because if you knew right now, I’d distrust it.”
They had met inside trauma and investigation.
Attachment can confuse gratitude, fear, fascination.
Time needed.
Then Dante asked:
“What do you want today?”
“Coffee.”
“Manageable.”
They talked about:
books.
bad Manhattan rent.
Clara’s graduate thesis.
Dante’s hatred of olives.
No fire for twenty minutes.
That was progress.
Then she asked:
“Do you remember anything good from before Hastings?”
Dante thought.
A kitchen.
His mother humming.
Samuel reading newspaper.
A red cereal bowl.
Maybe real.
Maybe reconstructed.
He said:
“I remember pancakes.”
Clara smiled.
“Good.”
No need verify every memory.
Then Oliver.
Dante legally kept Dante Costa.
No name change.
He added a sealed personal file acknowledging birth identity for estate and medical records.
Publicly, when asked, he said:
“Oliver Reed was my birth name. Dante Costa is my legal name.”
No dramatic dual persona.
Then an investigative documentary requested interview.
He refused.
Clara accepted one limited interview about archival ethics, not his childhood.
Good.
Then Thomas Ward.
He apologized publicly? No.
Private.
Clara decided relationship could continue with boundaries:
no lying about Helen.
no dismissing her work as obsession.
no demands to stop researching.
Thomas agreed.
Slow repair.
Then Dante’s sentence.
Thirty-two months.
Financial penalties.
forfeiture.
supervised release.
management restrictions.
Long enough to matter.
Before surrender, he met Marco.
They sat in same sunroom.
Marco said:
“I’m sorry.”
“For which thing?”
“Good question.”
Then specific:
lying about Roth.
hiding Helen’s connection.
doing business with Roth afterward.
letting Dante believe secrecy meant safety.
Dante listened.
Then:
“Do you forgive me?”
“No.”
Marco nodded.
Then Dante added:
“Maybe later.”
Not promise.
Then Marco said:
“You’re still my son.”
Dante looked.
“Am I?”
“You decide.”
Better.
No ownership.
Then Kieran drove Dante to surrender.
Not Clara.
Dante chose that.
At gate, Kieran said:
“Boss.”
Dante looked.
“Stop calling me that.”
Kieran smiled.
“Dante.”
Then Dante went inside.
For the first time since he was six, nobody changed his name, his location, or his future without telling him.
He had made the choice himself.
That did not make prison freedom.
Prison preparation brought one practical issue Dante had never considered.
Who would make medical and business decisions if he became unavailable?
Old answer:
Kieran.
Marco before him.
One trusted man.
He changed it.
Medical proxy:
a civilian attorney with clear written directives and one family friend.
Business:
board authority.
Security:
licensed firm under contractual limits.
No single person inherited Dante.
Malcolm Price said:
“You finally believe in institutions?”
“No.”
“Then why?”
“Because I believe in people less.”
“Close enough.”
Then Clara asked whether he wanted her listed anywhere.
“No.”
She looked surprised.
“Why?”
“Because we are not married, and I don’t want crisis to turn our relationship into legal authority you never asked for.”
That answer mattered.
Then he added:
“Emergency contact?”
She thought.
“Yes.”
Specific.
No ownership disguised as intimacy.
The days before surrender also forced Dante to confront employees who were afraid his legal problems meant their jobs would vanish.
He held one company meeting.
No speech about family.
No promise everything would be fine.
He said:
“Some divisions will close. Some will sell. Payroll and pensions are being separated from disputed assets. Ask your managers what affects you. If they don’t know, they should say they don’t know.”
A warehouse worker raised hand.
“Are we supposed to trust that?”
Dante answered:
“No. You should verify through the administrator.”
That surprised room.
Good.
Then one older employee asked:
“Was Mr. Marco involved in the old fire?”
“No evidence he knew before it happened.”
Specific.
“Was his company?”
“One employee appears to have sold access.”
“Then why keep Costa name?”
Dante had not considered.
He said:
“I don’t know.”
Later, board debated rebranding.
They did not erase name immediately.
Some businesses had decades of legitimate identity under it.
Some victims associated it with harm.
Independent marketing decision seemed trivial beside moral history, but names carry power.
Eventually certain companies rebranded after sales.
Others retained Costa under new governance.
No single cleansing gesture.
Then Dante’s sentencing memorandum included childhood trauma.
His lawyer said it could help explain development.
Dante allowed factual history.
He refused language suggesting the fire excused later crimes.
Malcolm looked annoyed.
“It is mitigation.”
“It can be context without becoming permission.”
The judge ultimately considered background among many factors.
Dante accepted.
Then Clara visited him once before surrender.
Not romantic.
She brought back Helen’s tape copy.
“You keep it.”
He shook head.
“No.”
“Why?”
“Because it belongs with you.”
“My mother recorded it for you.”
Dante thought.
Then:
“Keep original. Give me a verified digital copy.”
Compromise.
He stored copy with legal papers.
Not under pillow.
Not altar.
Then the night before surrender, Dante slept badly.
At 3:00 a.m. he woke smelling smoke that was not there.
He walked kitchen.
checked stove.
checked alarms.
Then stopped.
Compulsion can disguise itself as safety.
He sat.
Named:
apartment.
night.
no smoke.
no alarm.
The grounding words no longer needed Clara in room.
That mattered.
He made coffee anyway.
Terrible idea at 3:00.
Then morning came.
Kieran drove.
Dante looked at Manhattan shrinking behind them.
For once he did not feel like he was being taken somewhere.
He was going.
Responsibility can still feel like loss.
May you like
It simply belongs to the person who chose.
It made responsibility his.
